Types of Child Custody Agreements & Visitation

Custody arrangements in Virginia include:

  • Physical custody, or where the child will spend most of their time, including visitation schedules, or where they will live.
  • Legal custody, or the rights of each parent to make decisions on behalf of the child, including their medical care, their religion, and their education.

As defined in Chapter 6.1, Title 20 of the Code of Virginia, the above can be awarded as either joint, where parents remain equally responsible for the physical and/or legal custody of the child, or sole custody, where one parent is the primary authority. Visitation schedules will also be determined by a family law court, but visitation can be adjusted at a later time if necessary.
